Water Management And Licenses

Water Use in South Africa is managed through a water use registration process. This process mandates that every water use is registered either with the Department of Water and Sanitation (DWS) or an established Catchment Management Agency (CMA). According to Section 21 of the National Water Act, 1998 (Act No. 36 of 1998), an applicant must apply for a water use license under the following circumstances:

  • Section 21 (a) if they intend to abstract water
  • Section 21 (b) if they intend to store surface or groundwater
  • Section 21 (c) and (i) if their activity falls within a 500-metre radius from any wetland, involves crossing any wetland or river, or entails the destruction of any wetland.
  • Section 21 (f) if they intend to discharge water or water containing waste into the environment
  • Section 21 (g) if they intend to dispose of any waste
  • Section 21 (j) if they intend to remove groundwater during construction activities.

Water Use License

The Water Use License Application (WULA) process consists of four phases, which are managed by our in-house Water Use License Specialist, in conjunction with the Department of Water and Sanitation (DWS). These phases are:

  1. Pre-application Enquiry phase – during which details of the intended water use(s) are provided, and a consultation meeting with DWS is arranged after submission to determine the extent of the application and the relevant type of authorisation process, i.e., GA or WULA.
  2. Application Phase – during which further details about the water uses are provided, and administrative documents are submitted.
  3. Site Inspection Confirmation Phase – during which DWS initiates a Site Visit with the WULA Specialist.
  4. Technical Report Phase – during which technical documents as stipulated in the Acknowledgement Letter are uploaded, and the water use registration forms are captured (applicable to Licence applications only).

Water Sampling

Wallace and Green conducts water sampling and monitoring for both surface and groundwater at various sites. In order to ensure the planned, coordinated, organized, effective, and efficient undertaking of Water Sampling functions, we undertake the following process:

  • Review the relevant licenses, such as Environmental Authorisation (EA), Environmental Management Programme Report (EMPr), Waste Management Licence (WML), and Water Use Authorisations
    (licence or general authorisation), to understand the project’s scope and the licence requirements.
  • Conduct site visits to identify all wetland/river crossings and take photos before construction begins.
  • Conduct water sampling prior to and/or during construction at the identified sampling points, in the frequency stipulated in the relevant licence/authorisation.
  • Compile a report on the water analysis and submit it to the relevant authority.
